Dissemination of fake news on the networks is now punishable by five years in prison
A legislative decree on combating offenses relating to information and communication systems was published in the Official Gazette on Friday, September 16, 2022, to establish the provisions aimed at preventing offenses relating to information and communication systems. communications and their suppression, as well as those relating to the collection of electronic evidence in connection therewith and to support international efforts in the field, and this within the framework of international, regional and bilateral agreements ratified by the Republic of Tunisia.
This decree defines several offenses and the penalties incurred. In this context, we can quote:
Concerning rumors and fake newsshall be punished with five years of imprisonment and a fine of 50,000 dinars, whoever knowingly uses information and communication systems and networks for the purpose of producing, spreading, disseminating or sending or writing false news, false data, rumours, false or falsified documents or erroneously attributed to others with the purpose of violating the rights of others or harming public safety or national defense or spreading terror among the population.
Is liable to the same penalties as any person proceeding to the use of information systems to publish or disseminate false or falsified news or documents or information containing personal data, or the attribution of unfounded data intended to defame others, damage their reputation, harm them financially or morally, incite attacks against them or encourage hate speech. The set fines are doubled if the person in question is a public official or similar.
A sentence of three months to one year in prison and a fine of ten thousand dinars to anyone who knowingly illegally accesses or remains in a computer system in whole or in part. Anyone who knowingly exceeds the limits of the right of association granted to him shall be punished with the same penalty. The attempt is punishable.
A sentence of three years imprisonment and a fine of twenty thousand dinars, anyone who knowingly and without right uses technical means to intercept communication data in a non-public transmission within, from or to an information system, including the lateral radiation emitted by the system and carrying communication data. Interception includes obtaining data regarding traffic flows or their content, as well as copying or recording them. The attempt is punishable.
A sentence of three years imprisonment and a fine of twenty thousand dinars, anyone who knowingly damages, alters, deletes, cancels or destroys computer data. The attempt is punishable.
A sentence of three years imprisonment and a fine of thirty thousand dinars, anyone who knowingly and unlawfully interferes with the operation of a computer system by entering computer data into it or send them, damage them, change them, delete them, cancel them, destroy them or by using any other electronic means. The attempt is punishable.
Five years imprisonment and a fine of thirty thousand dinars, anyone who intentionally appropriates computer data belonging to others. The attempt is punishable.
Six years in prison and a fine of one hundred thousand dinars anyone who intentionally causes property damage to others by entering, changing, erasing or erasing computer data or by any kind of damage to the functioning of a computer system with the aim of obtaining a financial or financial advantage for himself or others.
Five years imprisonment and a fine of one hundred thousand dinars anyone who commits forgery capable of causing harm by entering, altering, erasing or erasing computer data resulting in the production of false datawith the intention of exploiting it as if they were authentic.
