Following a graceful appeal, the 40 Arpents collective created by several local residents and the Adhave (the local association for the protection of the rights of the inhabitants of Voisins) had decided to seize the Administrative Court of Versailles. The decision annuls the discussion in the Saint-Quentin-en-Yvelines Community Council on 5 March 2020, which is considering downgrading to PLUi (inter-municipal local urban planning plan) of the Square des 40 Arpents protected landscape area “encumbered with manifestly incorrect estimates”, the procedure states.

four years of struggle

This finding is the result of four years of struggle and procedure. This is in November 2018 that the municipality had voted to install a new cemetery on the site of Square des 40 Arpents, then the revision of the PLUi regarding the downgrading of the protected area on Square des 40 Arpents to reserve its task as a cemetery.

A petition had been launched. Over 1,000 people had signed it online, over 200 door-to-door. “This represents 95% of all residents of the Parc de Port-Royal and rue aux Fleurs,” points out Jacques Richard.

The collective refused to see the cemetery set up in the square of 40 Arpents for various reasons. “It was mainly the removal of a green area and the felling of more than 70 trees. We also mentioned the risk of bacterial contamination of the groundwater table and contamination of basements in neighboring houses into which the water penetrates. Soil surveys

Soil surveys conducted by the city’s technical services had concluded that the cemetery project was possible on the site with 40 Arpents. Then, in July 2020the conclusions of a hydrogeologist commissioned by the municipality contradicted the first study and confirmed in a report the presence of a low water level at this site.

“Among his studies, we never knew whether the cemetery would respect the 35 meters from the residences,” emphasizes the active member of the 40 Arpents collective. “I am here to uphold the law, not to break it. The 35 meters were well respected,” the elected official replies.

However, the Commissioner of Inquiry in charge of the public inquiry at the end of 2019 had drawn the attention of the administrative authorities and stated in his report that the square with 40 timber trees did not seem to be the best possible place for a cemetery and that it was necessary to seek whether other land in the city could not advantageously replace this location, ”explains the collective member.

‘Justice has done its work. In 2018, I expressed doubts about the legality of the negotiation and my uncertainty about the project. Four years have thus been foolishly lost because of the mayor’s attitude, governed by his stubbornness rather than by common sense, laments Olivier Afonso, a local councilor in the opposition. I have the feeling that today nothing has really changed. After the cemetery, I wonder about the management of the mayor’s projects. »

“All terrain has limitations, there is no ideal terrain. The cemetery must be completed in 2023, to relieve the other cemetery, which will be saturated in 2024”, testifies Alexandra Rosetti.

It is at Champ-du-loup, located behind Chamfleury’s residence, instead of the rugby field, that the new cemetery will be created. “It is more than 50 m from the local residents, they will not be affected. Travelers often settled here. The work will begin at the end of the year or at the beginning of next year,” the mayor concludes.
